1. Introduction
The terms of service set forth form the basis of Firstclass.com.au membership agreement. Within this agreement, the words “First Class" and “we" refer to the website and business firstclass.com.au.
Entry into the First Class Membership Programme constitutes acceptance of the terms of service and so bound by its conditions, policies, and notices stated herein.
2. Program Changes
2.1 First Class reserves the right to make alterations and correct any errors, inaccuracies or omissions to the terms of service, its benefits and fees at its sole discretion from time to time.
2.2 Any ambiguities in the interpretation of the terms of service should not be construed against the drafting party.
2.3 First Class will endeavour to take all reasonable steps to advise members promptly of any changes to its terms of service, benefits or fees by email or post at the address provided.
2.4 The Member agrees to indemnify First Class of any liability caused, tangible or not, by failing to notify the Member of the above mentioned changes.
3. Termination
3.1 First Class offers no warranty on the continuity or the availability of the Membership Programme or any Benefits. First Class reserves the right to terminate or suspend this programme at any time.
3.2 The Member agrees to indemnify First Class and not hold liable for any actions that First Class deems necessary for the benefit of other members or First Class.
3.3 The death of a Member automatically terminates this agreement. First Class will immediately cancel this agreement upon notification of the Member’s death.
4. Breach of Terms and Conditions
4.1 Should a Member knowingly or unintentionally breach the terms of service, such action may result in immediate suspension or termination of Membership. Further disciplinary action may include the removal of any benefits or rewards accumulated.
4.2 The decision to cancel, suspend or penalise any member is at the sole discretion of First Class.
4.3 The Member agrees to indemnify First Class from any liability, damage or loss incurred due to membership cancellations or suspension. The Member accepts cancellation of membership results in the termination of any benefits or rewards accumulated due to participation within the programme.
5. Member Obligations
5.1 Members must not:
— abuse facilities, services or arrangements accorded to the Member as a result of Membership;
— attempt to defraud First Class to gain financial benefit by manipulating benefits or rewards while participating in this programme.
— supply or attempt to supply misleading information or make any misrepresentation to First Class; or
— act in any way to the detriment of First Class interests or breach the terms of service.
5.2 Members must comply with these terms of service at all times.
6. Membership
6.1 Membership is open to individuals only. Membership is unavailable to families, groups, companies; trusts, partnerships; other entities, government departments, or agencies. First Class may extend some of the membership benefits to your immediate family (spouse and children) at its discretion.
6.2 Membership is available at the discretion of First Class. First Class reserves the right to accept or reject any application for Membership at its sole discretion.
6.3 Each Member may maintain only one First Class account.
6.4 Change of mind: members may cancel their Membership within two weeks of activation and receive a full refund if the Membership is unused. If, within 12 months, we do not save you time and money; we will refund your membership fees. Membership is not transferable to any other party.
6.5 Upon acceptance of enrolment, each Member will be assigned a membership number and login into the First Class members area. The membership section will allow members to view pertinent information about offers, rewards and keep their personal account information up-to-date. Members are responsible for the security of their login access. We recommend that you do not reveal your account details to anyone.
6.6 Your mailing address determines a member’s eligibility for promotions and other offerings. Changes to address can be made directly on the website within the membership section or by calling our office. Each Member must advise First Class of any change of name, address, or other details as soon as practicable after the change. First Class is not responsible for any failure by the Member to adequately notify Firstclass.com.au of the change. For a change of name, supporting documents are required.
6.7 You consent and authorise First Class to use the information provided on your application form along with other information you provided directly to First Class to use without limitation to a related body corporate, agents and contractors for;
— Providing services to First Class customers and members;
— To improve its customer service through research, marketing, product development and planning;
— Market its products or services or the products or services of its partners; and
— To aid third-party service providers assisting First Class in administering its website or services.
— The Member acknowledges that if any information is not provided in part by the Member, services provided may be affected.
6.8 First Class will provide you with access to, and correction of your personal information held by Firstclass.com.au on request by you to the extent permitted or required by law. Only the Member named on the account will be entitled to access account information. Under internal policy, First Class will comply with validly served and executed court orders and subpoenas and cooperate with investigations by state and federal agencies as required by law.
7. Payment & Cancellations
7.1 Memberships are subject to an initial joining fee at the time of signup and a recurring annual fee payable on the anniversary of joining. A joining fee of $495.00 applies to all new memberships. From time to time introductory offers may be applied to the new memberships and the joining fee adjusted accordingly—all memberships renew at the same annual rate of $495.00.
7.2 Introductory Membership offers the same membership benefits as regular membership—only the joining fee is adjusted.
7.3 Membership joining fees and Introductory Membership fees are published on the membership benefits page and at the time of checkout.
7.4 All Membership fees are charged at the time of checkout. All memberships are subject to renewal at the standard annual membership rate as stated on the member benefits page or in accordance with the annual membership rate notice. All members will be notified no later than 30 days prior to membership renewal.
7.5 The customer agrees the membership account name will be in the same name as the card holder name specified at checkout.
7.6 All membership and introductory membership recurring fees are subject to change at any time and published on the member benefits and membership checkout page or as indicated on the annual membership renewal notice.
7.7 Members can cancel their membership at any time by emailing members@firstclass.com.au.
7.8 Membership fees are non-refundable except when approved by management or made within two weeks of commencement of membership as stated in the terms 6.4 of the terms of service.
